By accessing or using SetandPay ("the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.

Description of Service

SetandPay is a platform that enables fitness professionals, trainers, and coaches to:

  • Set up recurring subscription plans for clients
  • Process automated payments
  • Manage client relationships
  • Handle billing and subscription management

User Accounts

Account Creation

  • You must be at least 18 years old to create an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to provide accurate and complete information
  • You are responsible for all activities that occur under your account

Account Types

  • Trainers: Fitness professionals who create and manage subscription plans
  • Clients: Individuals who subscribe to trainer plans

Payment Terms

For Trainers

  • You may set up subscription plans with pricing you determine
  • Payments are processed through Stripe
  • You are responsible for setting up and maintaining your Stripe Connect account
  • Platform fees may apply as disclosed at the time of account setup

For Clients

  • Subscription fees are charged according to the plan you select
  • Payments are processed automatically according to the billing cycle
  • You authorize us to charge your payment method for subscription fees
  • Refunds are subject to the trainer's refund policy

Subscription Management

Cancellation

  • Clients may cancel subscriptions at any time through their account
  • Cancellation takes effect at the end of the current billing period
  • Trainers may cancel or modify plans, subject to existing client subscriptions

Refunds

  • Refund policies are determined by individual trainers
  • Platform fees are generally non-refundable
  • Chargebacks and disputes are handled through Stripe

User Conduct

You agree not to:

  • Use the platform for any illegal or unauthorized purpose
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful code or malware
  • Interfere with the platform's operation
  • Impersonate others or provide false information
  • Harass, abuse, or harm other users

Intellectual Property

Our Content

  • All content on the platform, including logos, text, and design, is owned by SetandPay
  • You may not reproduce, distribute, or create derivative works without permission

Your Content

  • You retain ownership of content you submit
  • You grant us a license to use, display, and distribute your content on the platform
  • You represent that you have the right to grant such license

Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SetandPay SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Indemnification

You agree to indemnify and hold harmless SetandPay, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the platform or violation of these Terms.

Termination

We reserve the right to:

  • Suspend or terminate your account for violation of these Terms
  • Discontinue or modify the platform at any time
  • Remove content that violates our policies

Dispute Resolution

Any disputes arising from these Terms or your use of the platform shall be resolved through:

  • Good faith negotiation

  • Applicable law and jurisdiction

Changes to Terms
